The session will: (1) discuss the history and basic science of PFAS, (2) review recent legislative and regulatory developments concerning PFAS in products including consumer health products, and (3) highlight recent class action litigation and expected future litigation trends. Given the substantial activity in state legislatures around the US that are prohibiting PFAS in certain classes of products, and the recently filed class action lawsuits relating to false advertising on the basis of undisclosed PFAS, this subject matter will be of significant importance to attendees.

  • Trenton H. Norris

    Trent Norris is one of the foremost consumer product attorneys in the country. His litigation, counseling, and government advocacy practice involves some of the most significant challenges for manufacturers and retailers of everyday products and services.

    He litigates complex scientific and technical disputes involving consumer protection, advertising, environmental, and food and drug law, with a particular emphasis on the unique requirements of California law. His more than 25 years of experience with regulators, prosecutors, activists, bountyhunters, and plaintiffs lawyers also provide clients with practical perspectives on litigation avoidance.

    His practice involves diverse products, technologies, and industries, including foods, beverages, dietary supplements, cosmetics, medical devices, electronics, drugs, and agriculture. He regularly represents trade associations and joint defense groups in strategic counseling, advocacy before regulatory agencies, and challenges to agency actions.
    He is also registered as a lobbyist before the California Environmental Protection Agency and its sub-agencies.

  • Elissa J. Preheim

    Elissa Preheim is an experienced litigator who focuses her practice on toxic tort, environmental and complex commercial litigation, with an emphasis on class actions. She has significant experience litigating toxic tort lawsuits, Clean Water Act litigation and natural resource damages claims related to contaminated sites, including medical monitoring, personal injury and property damages actions.

    She regularly litigates high stakes matters involving parallel proceedings, including federal and state Superfund proceedings. She was a member of the trial team in Clean Water Act litigation relating to the Deepwater Horizon oil spill in the Gulf of Mexico, and she has litigated other high profile toxic tort matters, including the Hoosick Falls PFAS litigation. She has significant experience working with environmental, technical and other scientific experts.

    By court appointment, she serves on the Board on Professional Responsibility of the District of Columbia Court of Appeals. She previously served as Chair of a Hearing Committee of the DC Board on Professional Responsibility, hearing attorney disciplinary matters.

  • Will Wagner

    Will Wagner focuses his practice on consumer product defense, regulatory compliance and lobbying consumer product issues in California, with an emphasis on defending and advising companies on California's Proposition 65 law. He represents personal care product manufacturers, food and beverage producers, garment and accessory companies, and other companies in lawsuits relating to Prop 65 chemicals of concern—heavy metals, acrylamide, asbestos, PFOA, BPA, and more.

    He also defends consumer product companies against allegations of false and misleading label and advertising claims. His experience includes defending companies against putative or threatened class action lawsuits based on PFAS, greenwashing claims, nonfunctional slack-fill allegations, and claims relating to the purity of a product.

    He also regularly advises on issues relating to product formulation, centering on the proliferation of PFAS laws and regulations, as well as Prop 65 product compliance and risk mitigation. Finally, he is a registered lobbyist in California, focusing on legislation that impacts product companies.
